1. Acceptance of Terms

By downloading, accessing, or using Poker Wizard ("the App", "the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

Poker Wizard is a poker training application that provides Game Theory Optimal (GTO) strategy training through:

• Interactive preflop training quizzes
• GTO range visualization and study tools
• Progress tracking and performance analytics
• Offline training capabilities

The Service is available through iOS, Android, and web applications.

3. User Accounts

To use certain features of the Service, you must create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access

4. Subscription and Payments

Poker Wizard offers both free and paid subscription options:

• Free Tier: Limited features with 50 training sessions per month
• Premium Monthly ($9.99/month): Unlimited training, all features
• Premium Annual ($79.99/year): All premium features, 33% savings

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. You can manage and cancel subscriptions through your App Store (iOS) or Google Play Store (Android) account settings.

5. Free Trial

We offer a 7-day free trial for new users to experience premium features. The trial begins when you start your subscription. If you do not cancel before the trial ends, you will be charged the subscription fee. Free trials are limited to one per user.

6. Refund Policy

Refunds for in-app purchases are handled by Apple (App Store) or Google (Play Store) according to their respective refund policies. For web subscriptions processed through Stripe, you may request a refund within 14 days of purchase by contacting support@pokerwizard.app.

7. Acceptable Use

You agree NOT to:

• Share, transfer, or sell your account credentials
• Create multiple accounts to abuse free trials or promotions
• Reverse engineer, decompile, or disassemble the App
• Copy, reproduce, or distribute GTO data or content
• Use automated systems, bots, or scripts to access the Service
• Interfere with or disrupt the Service or servers
• Use the Service for any illegal or unauthorized purpose
• Violate any applicable laws or regulations

8. Intellectual Property

All content, features, functionality, GTO data, graphics, logos, and trademarks of the Service are owned by Poker Wizard and are protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without explicit written permission.

9. Educational Purpose Disclaimer

Poker Wizard is an educational tool designed to teach Game Theory Optimal poker strategy. We do not guarantee that using our Service will result in improved poker performance or financial gains. Poker involves significant risk, and you should only play with money you can afford to lose. We are not responsible for any gambling losses you may incur.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POKER WIZARD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.

12. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the Service will cease immediately. You may delete your account at any time through the app settings.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the App. Your continued use of the Service after changes constitutes acceptance of the new Terms.
